Terms of Service

These Terms of Service (“Terms”) govern your use of the Pingly mobile app and this website (together, the “Service”), provided by Guiware LLC (“we,” “us,” or “our”). By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

The Service

Pingly is a network utility for iPhone. It sends ICMP echo requests (pings) to hosts you choose, measures latency, jitter, and packet loss, scores your connection, and keeps a local history of your sessions. We may add, change, or remove features over time, and we may update or discontinue parts of the Service.

Eligibility

You must be at least 13 years old, and old enough to form a binding contract in your jurisdiction, to use the Service. By using the Service, you represent that you meet these requirements.

Acceptable Use

Pingly is meant for diagnosing your own connection and testing hosts you are allowed to test. You agree to use it responsibly. In particular, you agree not to:

• Ping or probe hosts, networks, or systems you do not own or have permission to test.
• Use the Service to disrupt, overload, or interfere with any network, host, or service, or to attempt to gain unauthorized access to one.
• Use the Service in any unlawful way or to infringe the rights of others.

You are responsible for how you use the Service and for making sure your use complies with any applicable laws and network policies.

No Account Needed

Pingly does not require an account, and your sessions and settings are stored on your device. You are responsible for the security of your device and the data stored on it.

License to Use the Service

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to use Pingly for your own personal, non-commercial use. You agree not to:

• Copy, modify, distribute, sell, or lease any part of the Service.
• Reverse engineer or attempt to extract the source code of the app, except where this restriction is prohibited by law.
• Interfere with, disrupt, or attempt to gain unauthorized access to the Service or its related systems.

Purchases

If Pingly is offered as a paid app or includes any paid features, those purchases are processed by the Apple App Store and are subject to Apple’s terms. Pricing may change over time. Refunds are handled by Apple in accordance with its policies; please contact Apple for refund requests.

Accuracy and Reliance

Pingly reports network measurements that depend on your device, your connection, and the hosts you contact. Results can be affected by conditions outside our control and may be inaccurate or unavailable. The Service is a diagnostic aid, not a guarantee of network performance, and you should not rely on it where accuracy is critical.

Intellectual Property

The Service, including its software, design, and content, is owned by Guiware LLC and protected by intellectual property laws. These Terms do not grant you any rights in our trademarks or branding.

Third-Party Services

The Service may rely on or link to third-party services, including the Apple App Store and the hosting and analytics providers behind this website. We are not responsible for third-party services, and your use of them may be subject to their own terms.

Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we handle your information.

Disclaimer of Warranties

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely accurate.

Limitation of Liability

To the fullest extent permitted by law, Guiware LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of the Service. To the extent we are found liable, our total liability will not exceed the amount you paid for the Service.

Indemnification

You agree to indemnify and hold harmless Guiware LLC from any claims, damages, or expenses arising out of your misuse of the Service or your violation of these Terms.

Termination

You may stop using the Service at any time and may remove the app. We may suspend or terminate your access to the Service if you violate these Terms or use the Service in a way that could cause harm. Provisions that by their nature should survive termination will continue to apply.

Governing Law

These Terms are governed by the laws of the United States and, to the extent applicable, the laws of the state in which Guiware LLC is organized, without regard to conflict-of-laws principles.

Apple App Store Terms

The following additional terms apply because you obtained Pingly through the Apple App Store:

• These Terms are between you and Guiware LLC only, not with Apple. Apple is not responsible for the Service or its content.
• Apple has no obligation to provide maintenance or support for the Service.
• In the event the Service fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the Service.
• Apple is not responsible for addressing any claims relating to the Service, including product liability, legal or regulatory compliance, or consumer protection claims.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Service after changes take effect means you accept the updated Terms.
